AND DUTIES
POLICY STATEMENT:
The Board believes that as a corporate body it is charged with the responsibility of providing educational services to students’
resident within the Division.
REGULATIONS:
1. The
powers of the Board may only be exercised by the Board, in a duly constituted
meeting, unless delegated by means of written Board policy or resolution of the
Board.
2. Trustees
shall exercise only such authority as may be delegated to them by the Board.
GUIDELINES AND
PROCEDURES:
1. Generally,
the Board will exercise its power by the performance of legislative, appeal,
and appraisal functions.
2. The
legislative function is performed by the formulation and adoption of
a. educational objectives in keeping with the goals adopted
by the Legislative Assembly, and the needs and aspirations of its students
b. policies
that give direction to its employees, students, and electors
In the formulation of
policy, statutory obligations, local aspirations, and educational leadership
must be taken into account. Policy must
be broad enough to allow those affected to carry out their tasks effectively
and efficiently. Guidelines and
procedures affecting policy must be such that the real intent of the policy is
adhered to, and some measure of control is left in the hands of the Board
3. The
appeal function is performed by hearing and adjudicating appeals against
a. Board
policy, guidelines and procedures
b. administrative
interpretation of Board policy, guidelines and procedures
c. other
circumstances as may be prescribed by statute
d. collective
agreements that may be in force between the Board and its employees
4. The
appraisal function is performed by
a. regularly
reviewing and assessing the impact of Board policy, guidelines and procedures.
b. regularly
appraising its own performance and that of its Executive Officer
c. periodically
visiting real property of the Board.
d. receiving
delegations that wish to appear before the Board
5. In addition to its legislative, appeal, and appraisal
functions, the Board specifically reserves unto itself the discharge of the
responsibilities listed below.
a. Personnel
1. hearing
and determination of appeals against disciplinary actions of employees up to
and including termination of employment
b. Buildings
1. approval
of non-budgeted expenditures
2. selection
of architects and consulting engineers
3. approval
of change orders
4. purchase
and sale of real property
5. approval
of joint-use agreements and leases
c. Curriculum
1. approval
of locally developed courses
2. hearing
and determination of appeals against the use, or content, of supplementary
instructional materials
d. Students
1. Approval,
prior to implementation, of resource fees charged to students
2. Approval
of school attendance boundaries.
3. Hearing and determination of
administrative recommendations concerning expulsion of students.
4. The Board shall endeavour to provide suitable educational opportunities for all
students.
e. Transportation
1. approval,
prior to implementation, of significant alterations to previously approved
school bus routes
f. Board
operations
1. approval
of the annual budget
2. review
of expenditures on a regular basis
3. approval
of the introduction, deletion, or major revision of existing education services
6. The Board shall give the Superintendent the
discretionary powers to deal with individual situations or cases, within the
limits established by Board policy. The
Board will support actions of the superintendent or designate, unless it considers that such action is a
misinterpretation or a violation of Board policy, or contrary to best
established practice.
7. The Board is responsible for ensuring open two-way
communication with all members of the local community.
8. Board
member conflict of interest
a. Each
trustee will be conversant with Sections 64, 65, 67, 68 (a - c), 69 (4), 70 (1
and 2) and 56 (1 - 3) of the School Act.
b. The
trustee is solely responsible for declaring himself or herself to be in
conflict of interest.
c. The
conflict of interest shall be limited to the provisions of Section 64 and 65 of
the School Act.
d. The
trustee will make a declaration of conflict of interest in the open meeting,
prior to Board or committee discussion of the subject which may place the
trustee in conflict of interest.
e. The trustee, upon making such declaration, shall request
the Board or committee secretary to record the declaration in the minutes of
the meeting.
f. Upon declaring herself or himself to be in conflict of
interest, the trustee shall leave the meeting.
